Terms and Conditions for Wellness and Workouts Giveaways

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

By entering a Wellness and Workouts giveaway (“Giveaway” or “Promotion”), you agree to these Terms and Conditions. The Giveaway is sponsored by Wellness and Workouts, operator of Wellness-and-Workouts.com (“Sponsor”).

1. Eligibility

Giveaways are open to legal residents of the United States who are 18 years of age or older at the time of entry, unless otherwise stated on the individual Giveaway page.

Immediate family members of the Sponsor are not eligible to enter.

Sponsor may request reasonable proof of eligibility or identity before awarding a prize.

2. Giveaway Period

The beginning and ending dates and times for each Giveaway will be stated on the individual Giveaway page.

Unless otherwise specified, all times are Pacific Time. Entries received before or after the stated Giveaway period will not be eligible.

3. How to Enter

No purchase or payment is necessary to enter or win, and a purchase will not increase your chances of winning.

Entry instructions will be provided on the individual Giveaway page. Entrants must follow the stated instructions for an entry to be considered valid.

Unless otherwise stated, each person is limited to one entry. Use of multiple email addresses, identities, or other methods to obtain additional entries is prohibited.

Incomplete, fraudulent, automated, or otherwise ineligible entries may be disqualified at the Sponsor's discretion.

4. Email Subscriptions

When an individual Giveaway includes an opportunity to subscribe to the Wellness and Workouts email list, subscribers may unsubscribe from future marketing emails at any time by using the unsubscribe link provided in each email.

Any email subscription requirement or optional subscription opportunity associated with a Giveaway will be explained on the individual Giveaway page.

5. Prizes

The prize or prizes and their approximate retail value will be described on the individual Giveaway page.

Unless otherwise stated, prizes are non-transferable and may not be exchanged for cash. Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable.

Digital prizes will be delivered electronically to the winner at the email address provided by the winner.

Odds of winning depend upon the number of eligible entries received.

No purchase or payment will improve an entrant's chances of winning. The FTC identifies these as fundamental characteristics of a legitimate sweepstakes.

6. Winner Selection and Notification

The winner will be selected at random from all eligible entries received during the Giveaway period.

Sponsor will notify the selected winner by email within seven (7) days after the Giveaway ends, unless otherwise stated on the Giveaway page.

The selected winner must respond within seven (7) days of the notification. If the selected winner does not respond within that period, is found to be ineligible, or otherwise fails to comply with these Terms and Conditions, the prize may be forfeited and Sponsor may select another winner at random from the remaining eligible entries.

Sponsor's decisions concerning eligibility, winner selection, and awarding of the prize are final.

7. Delivery of Prize

The winner must provide a valid email address for delivery of digital prizes.

Digital prizes will ordinarily be delivered within fourteen (14) days after the winner has responded and provided any information reasonably required to award the prize.

The winner will not be required to pay a fee or make a purchase to receive the prize.

8. Taxes

The winner is solely responsible for any federal, state, or local taxes or other obligations associated with receipt of the prize, if applicable.

9. Release and Limitation of Liability

To the extent permitted by applicable law, by entering the Giveaway, entrants agree to release and hold harmless Wellness and Workouts and its representatives from claims arising out of participation in the Giveaway or the acceptance or use of a prize.

Sponsor is not responsible for lost, late, incomplete, corrupted, misdirected, or otherwise unsuccessful entries resulting from technical problems, internet or email failures, human error, or circumstances beyond Sponsor's reasonable control.

10. General Conditions

Sponsor reserves the right to disqualify entrants who violate these Terms and Conditions, attempt to obtain entries fraudulently, interfere with the operation of the Giveaway, or otherwise act in bad faith.

If fraud, technical failures, or circumstances beyond Sponsor's reasonable control impair the integrity or proper functioning of the Giveaway, Sponsor reserves the right to suspend, modify, or cancel the Giveaway and, when appropriate, award the prize by random drawing from eligible entries received before the problem occurred.

Sponsor may update these general Terms and Conditions from time to time. The terms in effect during a particular Giveaway will govern that Giveaway.

11. Third-Party Platforms

Unless expressly stated otherwise, Wellness and Workouts Giveaways are sponsored solely by Wellness and Workouts and are not sponsored, endorsed, administered by, or associated with Etsy, MailerLite, or any other third-party platform referenced in connection with a Giveaway.

Any trademarks belonging to third parties are the property of their respective owners.

12. Privacy

Information submitted in connection with a Giveaway will be used to administer the Giveaway and as otherwise described at the time of entry and in the Wellness and Workouts Privacy Policy.

Entrants who choose to subscribe to Wellness and Workouts marketing emails may unsubscribe at any time using the unsubscribe link included in those emails.

13. Governing Law

These Terms and Conditions and matters relating to the Giveaway shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where prohibited or otherwise required by applicable law.
